Regulators Are Not the Bad Guys In Real Estate Investment - Alan Cowgill

"The SEC is not the bad guy," Cowgill said. "They are looking for the bad guys. They want legitimate business owners to prosper."
Cowgill recently addressed the subject of regulation in an article aimed at real estate investors. While speaking all over the nation, Cowgill said he came to realize that there is a lot of confusion about regulation, specifically SEC regulations regarding private lending. Cowgill said the confusion arises because each state establishes its own regulations and exemptions, bringing the SEC into play when investors cross state lines with private lending such as buying a house in one state with funds from lenders located in another state.
"Investors do need to know their state's rules, and they need to play by those rules," Cowgill said.
As an example, he noted that he had an attorney research the regulations in his home state of Ohio. Real estate investors there can acquire up to nine private lenders without having to inform regulators, but if they go over the nine-lender limit, they must file simple paperwork with the state. They also need to provide a disclosure statement to potential lenders, they can't pool lender money without filing the proper paperwork, and they can't use the word "guarantee" in their advertising. Of course, regulations vary from state to state.
"Regulators really are very willing to help you if you just ask," Cowgill said. "They just want you to comply with their regulations."
